                          2011 ZONING ADMINISTRATOR’S REPORT 

As the Town of Highgate Zoning Administrator, I processed 84* land use permit applications in 2011.  The various types & total fees collected are listed below:

*Some individual permits included approval for several different structures on the same permit.

Zoning permits are required for all new structures 50 square feet or larger and for any change of use of a property. The fees vary depending on the type of structure and/or use. Farm structures, as defined by state statute, require the filing of a Farm Structure Sketch that illustrates the size of the structure and the setback distances to the property lines and center of the road but no application fee is applicable. Any new access on to a Town highway for either a driveway or private subdivision road requires a driveway permit issued by the Highway Foreman. Any new or replacement septic system must apply for a state permit at the VTDEC Permit Specialist. Call (802) 879-5676 for more detailed information. 

All necessary municipal land use permit applications are available at the Town Clerk’s office or online at www.highgate.weebly.com.  Copies of the Town Plan and land use regulations (zoning, floodplain, & subdivision) are available for purchase at the Town Clerk’s office for a small fee or for free on the Town’s website. For more information or to schedule an appointment, please call the Administrator’s office at 868-4922, extension 203. The Town is always in need of concerned citizens to serve on its boards and commissions.  Workshops and training sessions are available. For information or to volunteer, contact any board or commission member or the Town Administrator’s office. Volunteer applications are available on the Town’s website or at the Town Clerk’s office. All position appointments are approved by the Selectboard.

                2011 ZONING BOARD OF ADJUSTMENT REPORT

The five member Zoning Board of Adjustment (ZBA) reviews applications for conditional uses, waivers, variances, and appeals of administrative decisions.  In 2011, the ZBA heard 1 variance appeal, 1 reconsideration of a conditional use approval, 1 conditional use/setback waiver appeal, and 7 conditional use appeals.  The fees for these applications generated  $1,500  in revenues for the Town.

The ZBA’s regular meeting time is on the second Thursday of the month at 6 p.m. as needed. They are open to the public.  Any Highgate resident interested in serving on the ZBA may submit a completed Volunteer Application to the Town Administrator. The application forms are available at the Town Clerk's office during regular business hours or on the Town's website at: www.highgate.weebly.com.

                       2011 PLANNING COMMISSION REPORT

The Planning Commission members dedicate a good deal of their time in service to the Town. They meet regularly on a monthly basis. Two proposed zoning amendments were acted on by the Commission in 2011 and later adopted by the Selectboard.  They dealt with reducing side and rear building setback distances in the Industrial/Commercial District and creating a more flexible waiver process for getting Zoning Board of Adjustment approval for reducing setbacks in all zoning districts. Copies of the zoning and subdivision regulations are available free on the Town's website by googling:  www.highgate.weebly.com or for a small fee at the Town Clerk’s office.

In 2011, the Planning Commission reviewed two major subdivision applications, nine minor subdivision applications, eight boundary line adjustment applications, and two site plan applications. Two of the minor subdivision applications were withdrawn by the applicants before receiving Commission approval.  The Commission also reconsidered two previously approved subdivisions at the request of the respective applicants for revisions to the original approval.  A minor subdivision consists of 3 or less lots.  A major subdivision consists of 4 or more lots. The applications generated $2,250 in fees to the Town.

Each subdivision application requires three phases of review by the Planning Commission.  Site Plans and Boundary Line Adjustments may be approved after one meeting review at the Commission’s discretion. In reviewing subdivision, site plan, and boundary line adjustment applications, the Commission hears input from the applicant and abutting property owners at a public hearing and sometimes makes a visit to the applicant’s site before reaching a decision. The Commission has the power to place reasonable conditions on cases that it approves.  The seven member Commission meets on the first Monday of each month at 6 p.m. to conduct business and review submitted applications.

Planning Commission meetings, which are usually held on the first Monday of each month, are open to the public. We encourage interested citizens to offer their suggestions for our consideration.
